1800s - 1900s

The early Republic and antebellum periods saw the federal regulation of naturalization laws (with the first law in 1790 restricting naturalization to "free white persons"). Yet, for much of the 19th century, the regulation of immigration remained under the jurisdiction of state and local entities. This began to change with the passing of laws such as the Page Act in 1875 and the Chinese Exclusion Act in 1882. An immigration law passed in 1891 eventually established the first federal immigration bureaucracy under the Treasury Department.

The regulation of immigration underwent dramatic changes over the course of the 20th century as immigration enforcement priorities changed. Laws passed in 1917, 1921, and 1924 imposed restrictions to entry, barred various groups from entry and naturalization, and imposed quotas. After the establishment of the Immigration and Naturalization Service in 1933, the federal entity was moved to the Justice Department in 1940. While the immigration law in 1965 formally abolished national origins quotas of the 1920s, it introduced hemispheric quotas and placed numerical restrictions on the Western Hemisphere for the first time.
